Terms of service

1 Scope of Application

(1) The following Terms and Conditions (T&C) apply for all sales contracts for cameras, photos, books, brochures, etc. between OstLicht GmbH and its customers, in the version valid on the day of the order. Deviating agreements must be made in writing. By placing an order, the customer agrees to these T&C and is bound by them.

(2) Should individual provisions in these T&C be invalid in whole or in part due to mandatory statutory provisions (in particular the provisions of the Austrian Consumer Protection Act), the remaining provisions of these T&C shall remain valid without change.

2 Conclusion of Contract

The offers of OstLicht GmbH are subject to change. OstLicht GmbH reserves the right to change the information contained therein at any time. The contract is concluded when OstLicht GmbH accepts the order, either by sending an order confirmation by mail, fax, or e-mail or by sending the ordered goods directly.

3 Contract Language

The content of the contract as well as all other information, customer service, and complaint management are offered in German (and English) throughout.

4 Right of Withdrawal in Distance Selling

(1) Customers who are consumers within the meaning of the Austrian Consumer Protection Act may withdraw from the purchase within 14 days of receipt of the goods without statement of reasons. It is sufficient if the withdrawal declaration is sent within said 14 days without statement of reasons (to be sent to info@coelncameras.com).

(2) In the event of a withdrawal, a refund of the purchase price shall only be made concurrently with receipt of the goods returned by the customer. Both the return of the goods and the reimbursement of the purchase price must be made within 14 days of the withdrawal declaration or return of the goods. This is conditioned on the returned goods being in an unused and resalable condition. OstLicht GmbH does not bear the costs of return shipment.

(3) For items impaired or damaged by signs of use, OstLicht GmbH will charge a fee commensurate with the reduction in value. The same applies if OstLicht GmbH has incurred production costs in advance.

5 Prices

(1) Generally, that purchase price for the ordered goods shall be deemed agreed which results from the current brochures, catalogues, price lists, web shop, and similar publications of OstLicht GmbH.

(2) Unless otherwise stated, all prices are daily gross prices in euros including VAT and shipping, handling and insurance.

(3) Should export or import taxes apply in the course of shipment, these shall also be borne by the customer. The prices for the goods and services offered do not include costs charged by third parties.

6 Terms of Delivery

(1) Delivery is usually made within 7 workdays from receipt of payment by the customer. If we are unable to accept an order—e.g., if an item is unavailable—we will inform the customer immediately.

(2) Delivery is made to the address provided by the customer. In the event of incorrectly, incompletely or unclearly provided information, the customer shall bear all resulting costs.

7 Terms of Payment

(1) Unless otherwise agreed, invoices shall be due immediately upon receipt of the invoice, without any deductions or expenses. We offer the following payment options: bank transfer or credit card (VISA or Master Card). The goods remain the property of OstLicht GmbH until full payment is received.

(2) Invoices are issued in euros.

(3) The statutory (default) interest pursuant to Article 1333 Section 1 of the Civil Code of Austria shall amount to 4 percent per annum for non-merchants pursuant to Article 1000 Section 1 of the Civil Code of Austria. Article 1333 Section 2 of the Civil Code of Austria states that “between entrepreneurs,” the statutory default interest “from entrepreneurial transactions" (= bilateral commercial transactions) amounts to 8 percent “above the base rate.”

(4) In the event of payment default, the customer must reimburse OstLicht GmbH for all payment-reminder and collection expenses necessary for adequate legal action and incurred by OstLicht GmbH as a result of this payment default. OstLicht GmbH reserves the right to assert higher damages caused by default.

(5) Reaction time for complaints: Inquiries will be answered within 4 workdays.

8 Warranty

The warranty is subject to the statutory provisions. If replacement or improvement cannot be taken into consideration (not possible, too much effort, unreasonable, delay), the buyer is entitled to a price reduction or, if the defect is not minor, to contract termination (redhibitory action). There shall be no compensation for consequential damages (or defects) as well as other property damage, financial loss, or third-party damage against the customer.

9 Risk Assumption for Delivery to Consumers within the Meaning of the Austrian Consumer Protection Act

When the goods are shipped, the risk of loss or damage to the goods is transferred to the consumer only when the goods are delivered to the consumer or to a third-party designated by the consumer and different from the shipping agent. However, if the consumer has concluded the shipping contract without using a shipping option proposed by OstLicht GmbH, the risk shall pass to the consumer as soon as the goods are handed over to the shipping agent.

11 Place of Jurisdiction and Applicable Law

(1) Austrian substantive law shall apply to this contract with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. If the contractual partner is a consumer, the mandatory provisions of the law of the country of the consumer’s habitual residence shall also apply to this contract.

(2) For disputes, the court in whose jurisdiction OstLicht GmbH is located is exclusively responsible.

(3) The place of jurisdiction and performance of the contract is the place of business of OstLicht GmbH.
